Factory Entertainment (herein after referred to as The Company) Limited Edition Limited Warranty ("Limited Warranty") covers defects in materials or workmanship for its Limited Edition Replicas (the "Product") for a period of ninety (90) days from the original date of purchase from Factory Entertainment or a Factory Entertainment authorized reseller. If a defect exists, at its option, Factory Entertainment may take one or more of the following actions:
Replacement of Product or Parts: The Product will initially be assessed by Factory Entertainment personnel. If deemed necessary, Factory Entertainment will supply, at no charge, new or rebuilt, at Factory Entertainment' option, replacement parts in exchange for defective parts. Any replacement parts will be warranted for the remainder of the original warranty period or 30 days from installation by Factory Entertainment' authorized service facility, whichever is longer. All defective parts replaced under this Limited Warranty will become the property of Factory Entertainment. Factory Entertainment reserves the right to replace the Product in its entirety, in lieu of repair or replacement of parts, at its option, subject to availability, free of charge. In the event that the Product is no longer available, Factory Entertainment may elect to replace the Product with another product of equal value.
Refund or Exchange: If you purchased your Product from a 3rd party retailer, you should contact that retailer to obtain instructions on how to return your Product and obtain a refund or exchange. 3rd Party Retailers are responsible for handling refunds and/or replacements, not Factory Entertainment.
Factory Entertainment recommends familiarizing yourself with any 3rd party retailers return/replacement policies before making a purchase.
If you purchased your Product directly from Factory Entertainment and it arrived damaged beyond repair, we will, at our option, provide you with either a replacement Product, subject to availability, or a refund of the purchase price of the Product, including shipping and handling. To receive a replacement or refund, you must follow the procedures described below for obtaining warranty service.
In order to obtain warranty service for your Product in accordance with the terms outlined above, you must contact Factory Entertainment prior to the expiration of the warranty period at tom@factoryent.com or 925-408-5660 to obtain a return authorization number. Within 10 days following receipt of a return authorization number, you must ship the Product in its original packaging to Factory Entertainment. You must also include proof of purchase in the form of a bill of sale (which is evidence that the Product is within the warranty period) in order to obtain warranty service. You must retain a copy of the bill of sale for your own records. We also recommend that you insure all shipped items because Factory Entertainment is not responsible for any damage suffered during transportation. You are responsible for the cost of returning the Product to Factory Entertainment. Please allow a minimum of six (6) weeks for warranty service.
Repairs to severely damaged Limited Edition replicas are not covered under this warranty. In the event that your replica arrives damaged beyond repair, you should contact the retailer from which you purchased it. If you purchased your replica directly from Factory Entertainment, you may obtain a full refund, including shipping and handling, within 30 days after purchase. Because each Limited Edition replica is strictly limited in number produced and sold, we may be unable to provide a replacement in lieu of a refund.
This Limited Warranty does not cover any damage due to (1) acts of God, accident, misuse, abuse, negligence, improper handling, commercial use or modifications of this Product, or normal wear and tear; (2) improper operation or maintenance of this Product; or (3) attempted repair by any party other than a Factory Entertainment authorized service facility or personnel. This Limited Warranty does not apply where it is determined by Factory Entertainment that there is no fault with the Product itself. Repairs not covered by the Limited Warranty may, at Factory Entertainment' discretion, be carried out at the owner's expense.
THIS LIMITED WARRANTY AND THE REMEDIES SET FORTH ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL OR WRITTEN, EXPRESS OR IMPLIED. FACTORY ENTERTAINMENT SPECIFICALLY DISCLAIMS ANY AND ALL IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IF FACTORY ENTERTAINMENT CANNOT LAWFULLY DISCLAIM IMPLIED WARRANTIES UNDER THIS LIMITED WARRANTY, ALL SUCH WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE LIMITED IN DURATION TO THE DURATION OF THIS WARRANTY. NO FACTORY ENTERTAINMENT RESELLER, AGENT, OR EMPLOYEE IS AUTHORIZED TO MAKE ANY MODIFICATION, EXTENSION, OR ADDITION TO THIS WARRANTY.
FACTORY ENTERTAINMENT SHALL NOT BE LIABLE OR RESPONSIBLE FOR ANY DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY, INCLUDING BUT NOT LIMITED TO, LOSS OF USE OF THE PRODUCT OR ANY ASSOCIATED EQUIPMENT, BREACH OF CONTRACT, NEGLIGENCE, STRICT LIABILITY OR ANY OTHER LEGAL THEORY RELATED TO THIS PRODUCT.
Some states do not allow the exclusion or limitation of incidental or consequential damages, or allow limitations on how long an implied warranty lasts, so the above limitations or exclusions may not apply to you. This Limited Warranty gives you specified legal rights, and you may have other rights which vary from state to state.
This Limited Warranty is non-transferable.
Historic Master Replicas Products
Prior to the purchase of the Master Replicas brand name and trademark by Factory Entertainment a number of products where produced and marketed by Master Replicas LLC. This Limited Warranty only covers Factory Entertainment products and does not apply to those products. This warranty only applies to products supplied by Factory Entertainment after May 1st 2009. Any enquiries concerning products supplied prior to that date should be addressed to Master Replicas LLC directly.
